- "Services" means any gardening and related services provided by the Company.
- "Client" refers to the individual or entity purchasing or engaging the Services.
- "Agreement" refers to the contract between the Client and the Company.
- "Site" refers to the location where the Services are to be performed.
2. Services Provided
Gardener Brockley offers a comprehensive range of gardening services designed to meet the diverse needs of our clients. Our Services include, but are not limited to:
- Landscape design and garden planning
- Planting and garden setup, including installation of trees, shrubs, and perennial plants
- Lawn care and maintenance, encompassing mowing, fertilizing, and pest control
- Pruning and tree care to ensure the health and aesthetics of your plants and trees
- Garden clean-ups, including removal of debris and waste
- Installation and maintenance of irrigation systems
- Seasonal garden preparations, such as winterizing and spring planting
2.1 Custom Services
We recognize that each garden is unique, and hence, we offer customized gardening solutions tailored to the Client's specific needs and preferences. Any additional or specialized services requested by the Client will be quoted separately, and unless agreed upon in writing, are not included in the standard service offerings.
3. Payment Terms
Clients are required to make payments for the Services as per the agreed schedule outlined in the service agreement. Payments can be made in advance, upon completion, or on a periodic basis, depending on the nature and scope of the Services provided.
3.1 Pricing
All pricing for the Services is transparently outlined in our service agreement. Prices are subject to change based on factors such as material costs, labor changes, or additional requests. The Company reserves the right to adjust prices with prior notice to the Client. Any amendments to pricing will be communicated and agreed upon before implementation.
3.2 Methods of Payment
We accept various methods of payment to provide convenience to our Clients, including but not limited to:
- Credit and debit card payments
- Bank transfers
- Cash payments
- Mobile payment platforms
Clients are expected to settle payments using the preferred method as agreed upon in the service agreement. Any delays or issues with payments should be communicated to the Company in a timely manner.
4. Cancellations and Refunds
We understand that circumstances may arise requiring the cancellation of Services. Clients may cancel Services by providing a notice period of at least 48 hours. Cancellations made without adequate notice may be subject to a cancellation fee as outlined in the service agreement.
4.1 Refunds
Refunds for any prepayments will be processed in accordance with our cancellation policy. Refunds are subject to the following conditions:
- Services not yet rendered at the time of cancellation are eligible for a full refund.
- Services partially rendered may qualify for a prorated refund based on the extent of completion.
- Non-refundable deposits or booking fees, if applicable, will be retained as specified in the service agreement.
4.2 Rescheduling
We strive to accommodate rescheduling requests to suit the Client's availability. To ensure timely and efficient service provision, rescheduling should be requested at least 24 hours in advance. While we aim to honor all rescheduling requests, they are subject to resource availability and may incur additional charges if requested on short notice.
5. Liability
Gardener Brockley endeavors to provide high-quality Services with due care and attention. However, our liability is limited as follows:
- We are not liable for any indirect or consequential losses arising from the use of our Services.
- Our liability for any direct damages is limited to the value of the Services provided.
- We are not responsible for any damage caused by third-party suppliers or contractors unless direct negligence is proven.
- Clients are responsible for disclosing any pre-existing conditions or factors that may affect the delivery of Services.
6. Intellectual Property
All materials produced by Gardener Brockley during the provision of Services, including designs, plans, and documentation, are the intellectual property of the Company. Clients are granted a limited license to use these materials for their personal use. Unauthorized use, reproduction, or distribution of these materials is strictly prohibited.
6.1 Use of Client Materials
If the Client provides any materials, including images or designs, these will be used solely for the purpose of fulfilling the Services unless otherwise agreed upon in writing.
7. Privacy Policy
Protecting the privacy of our Clients is of utmost importance. All personal information collected during the provision of Services is handled in accordance with our Privacy Policy, which is an integral part of these Terms and Conditions. We ensure that personal data is stored securely and is not shared with third parties without consent, except as required by law.
7.1 Data Security
Gardener Brockley employs industry-standard security measures to protect Client data from unauthorized access, alteration, or disclosure. Regular audits and updates are conducted to maintain data security.
7.2 Data Retention
Personal information is retained only as long as necessary to fulfill the purposes for which it was collected or as required by applicable laws and regulations.
8. Changes to Terms
Gardener Brockley reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes through appropriate communication channels, such as email or updates on our official website. Continued use of our Services after any changes implies acceptance of the new Terms and Conditions.
8.1 Notification of Changes
We will make reasonable efforts to notify Clients of significant changes to these Terms and Conditions. Notifications may include email notifications, website announcements, or direct communication during service provision.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Brockley operates. Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
10. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
11. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and Gardener Brockley regarding the use of Services and supersede all prior agreements and understandings, whether written or oral.
12. Waiver
No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert a right or provision is not a waiver of such right or provision.
